Terms of Service

1. Agreement to Terms

By creating an account or using FourScoped(the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including free-tier users, beta users, and paid subscribers.

2. Description of Service

FourScoped is a third-party solar system monitoring service that connects to EG4 Electronics inverter systems via their publicly accessible API endpoints. FourScoped is not affiliated with, endorsed by, or sponsored by EG4 Electronics, Inc. or any inverter manufacturer.

The Service provides real-time and historical data visualization, alert notifications, energy analytics, and related features for users of compatible solar inverter systems.

3. Third-Party API Dependency & Feature Changes

The Service relies on third-party application programming interfaces (APIs), including but not limited to those operated by EG4 Electronics, Inc. ("Third-Party APIs"). These APIs are not controlled by FourScoped and may be modified, restricted, discontinued, or made unavailable at any time without notice.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • Features of the Service may be added, modified, reduced, or permanently removed at FourScoped's sole discretion, at any time, with or without prior notice.
  • In the event that a Third-Party API restricts or terminates access, FourScoped may be required to suspend, degrade, or eliminate features that depend on that API. Such changes do not constitute a breach of these Terms by FourScoped.
  • FourScoped makes no guarantee that any specific feature will remain available for any particular duration, including for the duration of a paid subscription period.

4. Subscription Plans & Payment

FourScoped offers a free tier and paid subscription plans billed on a monthly or annual basis. All payments are processed securely by Stripe, Inc. By subscribing, you authorize FourScopedto charge your payment method on a recurring basis in accordance with your chosen plan.

4.1 Pricing

Prices are displayed at the time of purchase and are subject to change. FourScoped reserves the right to modify subscription pricing at any time. Price changes will be communicated via email and will take effect at the next renewal date for existing subscribers.

4.2 Refund Policy

Monthly subscriptions may be canceled at any time. Access continues until the end of the current billing period. No prorated refunds are issued for partial months.

Annual subscriptions are non-refundable. When you purchase an annual plan, you are paying for a full year of access to the Service as it exists at the time of purchase and as it may evolve during that period. No refunds, partial or otherwise, will be issued for annual subscription purchases under any circumstances, including but not limited to:

  • Cancellation of the subscription before the annual period ends
  • Reduction or removal of features during the subscription period
  • Restriction or discontinuation of Third-Party API access
  • User dissatisfaction with the Service
  • Non-use of the Service

4.3 Beta Access

Beta users granted access via invite code receive full Pro-tier access at no charge for the duration specified when the code was issued. Beta access may be revoked or converted to a paid plan at FourScoped's discretion with reasonable notice. Beta users are subject to all other provisions of these Terms.

5. Service Availability

FourScoped does not guarantee continuous, uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, technical failures, or circumstances beyond FourScoped's reasonable control, including third-party service outages, API restrictions, or changes imposed by inverter manufacturers.

6. User Accounts & Credentials

You are responsible for maintaining the confidentiality of your account credentials, including the EG4 login credentials you provide to enable monitoring. You agree not to share your account with others or use the Service in a way that would violate the terms of service of any third party whose systems you are monitoring.

7. Data Access & Confidentiality

To operate the Service and to provide support, diagnose issues, and help you interpret your system data, authorized FourScoped personnel may access your account, your connected system configuration, and the monitoring data retrieved on your behalf.

FourScoped treats your data as confidential. We will hold it in the strictest confidence and use it solely to operate, support, and improve the Service. We will not sell or rent your data, and we will not disclose it to any third party, except: (a) trusted service providers who help us run the Service (such as hosting, database, and payment processors) and who are bound by confidentiality obligations; (b) when you direct or consent to it; or (c) when required by law or to protect the rights, safety, or property of you, FourScoped, or others.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOURSCOPEDDISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NON-INFRINGEMENT.

Data displayed by the Service is sourced from third-party APIs and may be inaccurate, delayed, or incomplete. Do not rely on FourScoped data for safety-critical decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOURSCOPED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR EQUIPMENT, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL FOURSCOPED'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Modifications to Terms

FourScoped reserves the right to modify these Terms at any time. Material changes will be communicated via email to the address associated with your account. Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
